As chair of ASA and passionate advocate for all Subcontractors, I would like to invite you to review the attached document ‘Draft Building and Construction Security of Payment (Review Recommendations) Amendment Bill’.
Because subcontractors fail to register their formwork scaffolding, plant, equipment and various other property on the national Personal Property Securities Register (PPSR), many are not only losing ownership of their property, but also, as a consequence, their businesses.
The Fair Work Commission (FWC) has just handed down a decision varying the Building and Construction General On-site Award 2010 (“the Award”). The variation will result in an increased industry allowance, with majority of the Award disability allowances abolished. For the first time, the Award’s industry allowance will distinguish between “residential building and construction” on the one hand and all other forms of building on the other.
The ABCC will soon be conducting a security of payment audit campaign for employers covered by the Code for the Tendering and Performance of Building Work 2016 (Code).
Considering we’re in the midst of an infrastructure boom, it’s time to ask: what is going on?
